FITOLOGYS – TERMS & CONDITIONS

1. Introduction

Welcome to Fitologys Ventures LLP (“Fitologys”, “Company”, “we”, “us”, “our”).

These Terms & Conditions govern your access to and use of:

• Offline and online fitness services
• Coaching programs, consultations, and related offerings

By accessing or purchasing any service, you agree to be legally bound by these Terms.

2. Legal Status

This document is an electronic record in accordance with the Information Technology Act, 2000, and constitutes a legally binding agreement between you (“User”, “Client”) and Fitologys.

3. User Representations

By using our services, you represent and warrant that:

• You will update information when required
• You are 18 years or above
• You will not use services for any illegal or unauthorized purpose
• You will not misuse, copy, or exploit the platform

Fitologys reserves the right to suspend or terminate accounts for false or misleading information.

4. User Registration & Account Responsibility

• Users may be required to register
• You are responsible for maintaining confidentiality of credentials
• All activity under your account is your responsibility

Fitologys may suspend or modify accounts found inappropriate or harmful.

5. Services & Scope

Fitologys provides:

• Personal training (online/offline)
• Fitness coaching programs
• Diet and lifestyle consultation
• Group sessions
• Access to third-party professionals (including doctors, where applicable)

All services are provided on a best-effort basis, and results vary by individual.

6. Payments & Pricing

• All services are prepaid unless otherwise specified
• Pricing may change without prior notice
• Applicable taxes (GST, etc.) will be charged as per law

Failure to complete payment may result in denial of access.

7. Strict No-Refund Policy

• All payments are non-refundable and non-transferable
• No refunds will be provided for:
  • Lack of results
  • Change of mind
  • Medical or personal reasons
  • Non-attendance or partial usage

Exceptions, if any, are solely at Fitologys’ discretion.

8. Session Validity & Rescheduling

• Services must be used within the validity period of the plan
• Missed sessions may be forfeited
• Rescheduling is subject to availability and prior approval

9. Health & Medical Disclaimer

• Users must consult a qualified medical professional before starting any program
• Fitologys is not responsible for:
  • Injuries
  • Health complications
  • Adverse effects

Participation is at your own risk.

10. Trainer, Platform & Consultation Protection Clause

10.1 Non-Circumvention

Clients shall not directly or indirectly engage any trainer, coach, nutritionist, or professional introduced via Fitologys outside the platform during the engagement and for 12 months thereafter.

10.2 Doctor Consultation Services

• Fitologys may offer access to doctor consultations and expert advisory services at additional cost
• These services are:
  • Optional
  • Premium-based
  • Strictly non-refundable

Once booked:

• No cancellation or refund will be provided
• Missed consultations will be treated as consumed

10.3 Platform Integrity

Any attempt to:

• Bypass Fitologys
• Engage professionals outside the platform
• Share contact details for off-platform dealings

will be considered a material breach

10.4 Consequences of Breach

Fitologys reserves the right to:

• Terminate services without refund
• Permanently block access
• Initiate legal action
• Recover damages including:
  • Business loss
  • Trainer/consultant acquisition cost
  • Estimated lifetime value (LTV)

10.5 Liquidated Damages

In case of breach, the client agrees to pay ₹50,000 or 3x the service value (whichever is higher) as liquidated damages.

11. Intellectual Property

All content including:

• Workout plans
• Diet plans
• Videos and materials

are the exclusive property of Fitologys.

Users may not copy, reproduce, distribute, or exploit any content without written permission.

12. Limitation of Liability

Fitologys shall not be liable for:

• Lack of expected results
• Indirect or incidental damages
• Loss due to misuse of services

Maximum liability shall not exceed the amount paid by the client.

13. Indemnity

You agree to indemnify and hold Fitologys harmless from any claims, damages, or losses arising due to:

• Violation of these Terms
• Misuse of services
• Breach of applicable laws

14. Termination

Fitologys may suspend or terminate access in case of:

• Policy violations
• Misconduct
• Non-compliance

No refund will be provided upon termination.

15. Force Majeure

Fitologys shall not be liable for delays or failures due to events beyond control, including:

• Natural disasters
• Government restrictions
• Technical failures

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

All disputes shall be subject to the jurisdiction of Bhopal, Madhya Pradesh, consistent with your existing agreements

17. Modifications

Fitologys reserves the right to modify these Terms at any time.
Continued use of services constitutes acceptance of updated Terms.

USER AGREEMENT (FIT OLOGYS)

User Agreement

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”, “user”, or “client”), and Fitologys Ventures LLP (“Fitologys”, “we”, “us”, or “our”), concerning your access to and use of:

• Our website
• Mobile application (if any)
• Offline and online services
• Any related media form, platform, or communication channel

(collectively referred to as the “Platform” and “Services”).

Fitologys may engage trainers, coaches, consultants, doctors, or third-party professionals (“Service Providers”) to deliver certain services on its behalf. You acknowledge and agree that such Service Providers are authorized to provide services under this Agreement, and references to “we/us/our” shall include them wherever applicable.

By accessing, registering, or purchasing any service, you confirm that:

• You have read, understood, and agreed to be bound by these Terms
• You are entering into a legally enforceable agreement with Fitologys

Acceptance of Terms

IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING OUR SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

Continued use of the Platform or Services constitutes your explicit acceptance of these Terms.

Changes to Terms & Conditions

Fitologys reserves the right, at its sole discretion, to:

The information and services provided are not intended for distribution or use in any jurisdiction where:

Users accessing the Platform from outside India do so at their own initiative and are solely responsible for compliance with applicable local laws.

Binding Nature of Agreement

By using the Platform, you acknowledge that:

• This Agreement is legally enforceable
• You are bound by all clauses including payment, no-refund, liability, and penalty provisions
• Digital acceptance (click, payment, or usage) is equivalent to a signed agreement under applicable laws

Eligibility & User Capacity

You must be at least 18 years of age to create an account, purchase services, or enroll in any programs offered by Fitologys.

By accessing or using our Services, you represent and warrant that:

• You have the legal capacity and authority to enter into this Agreement
• You are compliant with all applicable laws and regulations
• All information provided by you is accurate and complete

Use by Minors

If you are under 18 years of age (“Minor”):

• You may use the Platform only under the supervision and consent of a parent or legal guardian
• The parent or legal guardian shall be the contracting party and will be fully responsible for:
  • All actions performed
  • Payments made
  • Health disclosures and consents

For any services designed for minors:

• The parent/guardian must complete registration
• Provide necessary medical, fitness, and safety disclosures
• Accept all Terms & Conditions and Privacy Policies on behalf of the Minor

Responsibility & Compliance

It is your sole responsibility to ensure that:

• You meet all eligibility criteria
• You have obtained required consents (where applicable)
• You are fit to participate in the selected services

Fitologys shall not be responsible for any consequences arising from misrepresentation of age, health condition, or eligibility.

Right to Restrict Access

Fitologys reserves the right to:

• Suspend or terminate any account
• Restrict access to Services

if:

• Eligibility criteria are not met
• False or misleading information is provided
• The Platform is used in violation of these Terms

Fitologys provides a range of fitness and wellness services. These may include, but are not limited to:

1. a) Personal Training & Coaching

Session-based or subscription-based services including online and offline personal training, guided workouts, and structured programs.

1. b) Nutrition & Lifestyle Coaching

Customized diet plans, lifestyle guidance, and habit-building support aligned with fitness goals.

1. c) Group Sessions & Community Programs

Access to group workouts, fitness programs, and accountability-based engagement models.

1. d) Rehabilitation & Corrective Programs

Programs designed for injury recovery, posture correction, and mobility improvement, guided by trained professionals.

1. e) Expert Consultations (Doctor & Specialists)

• Access to doctor consultations and expert advisory services may be provided at an additional premium
• These services are advisory in nature and do not replace clinical diagnosis or emergency care
• All such consultations are non-refundable and subject to availability

1. f) Digital Content & Resources

Access to workout plans, educational material, and fitness-related content provided by Fitologys.

Nature of Services

• All services are provided on a best-effort basis
• Results may vary depending on:
  • Individual consistency
  • Health condition
  • Lifestyle adherence

Fitologys does not guarantee specific results.

User Responsibility

It is your sole responsibility to ensure that:

• You meet all eligibility requirements
• You have disclosed all relevant health conditions
• You follow instructions provided by trainers and professionals

Fitologys shall not be liable for any consequences arising from:

• Misrepresentation of information
• Non-compliance with guidance
• Improper execution of exercises

Right to Modify or Withdraw Services

Fitologys reserves the right to:

• Modify, suspend, or discontinue any service offering
• Change program structure, pricing, or availability

at any time without prior notice.

Right to Restrict Access

Fitologys may suspend or terminate access if:

• Eligibility criteria are not met
• False or misleading information is provided

Health Disclaimer & Liability Waiver

Assumption of Risk & Waiver

By enrolling in or participating in any services provided by Fitologys Ventures LLP (“Fitologys”), including but not limited to personal training, group sessions, fitness programs, nutrition guidance, or consultations, you acknowledge and agree that:

• Fitness activities involve inherent risks, including but not limited to:
  • Physical injury
  • Health complications
  • Muscle strain, fatigue, or medical conditions
• You are voluntarily participating with full knowledge of these risks

You hereby waive, release, and discharge Fitologys, its:

• Trainers
• Coaches
• Consultants
• Doctors
• Employees and representatives

from any and all liability arising out of:

• Injury
• Illness
• Loss or damage
• Any adverse outcome related to participation in services

Medical Fitness Declaration

You confirm that:

• You are physically and medically fit to participate in fitness activities
• You do not suffer from any condition that may prevent safe participation

If you have any:

• Pre-existing medical condition
• Injury
• Ongoing treatment

you must inform Fitologys in advance and provide relevant medical information if required.

Failure to disclose such information may result in:

• Immediate termination of services
• No refund eligibility

Medical Consultation Requirement

Fitologys strongly recommends that you:

• Consult a qualified medical professional before starting any program
• Undergo regular health check-ups

If you choose to participate without medical consultation, you do so at your own risk.

No Medical Advice

All services provided by Fitologys, including:

• Training plans
• Diet plans
• Coaching guidance
• Doctor consultations (if opted)

are intended for general wellness and informational purposes only.

They do not constitute:

• Medical advice
• Diagnosis
• Treatment

No doctor–patient relationship is created through the Platform.

For any medical concerns, you must consult a licensed healthcare professional.

Doctor Consultation Disclaimer (Important)

• Any doctor consultations offered through Fitologys are:
  • Advisory in nature
  • Based on information shared by the client
• Fitologys does not guarantee:
  • Accuracy of diagnosis
  • Treatment outcomes
• These consultations:
  • Do not replace hospital care or emergency services
  • Are strictly non-refundable once booked

User Responsibility

You agree that:

• You will follow instructions provided by trainers and professionals responsibly
• You will not perform exercises beyond your capability
• You will immediately stop activity in case of discomfort or risk

Fitologys shall not be liable for any consequences arising from:

• Improper execution of exercises
• Ignoring professional guidance
• Non-adherence to plans

Limitation of Liability

To the maximum extent permitted by law:

Fitologys shall not be liable for:

• Any direct or indirect injury
• Health complications
• Loss, damage, or claims

arising from your participation in services.

Acknowledgement

By purchasing or using any service, you acknowledge that:

Mental Health & Coaching Disclaimer

Personal Responsibility

By using the services of Fitologys Ventures LLP (“Fitologys”), you acknowledge and agree that:

• All decisions, actions, and results arising from coaching, training, or consultations are your own responsibility

Fitologys, including its coaches, trainers, and consultants, shall not be liable for:

• Any action or inaction taken by you
• Any direct or indirect outcomes resulting from the services provided

Nature of Coaching Services

You understand and agree that:

• Coaching provided by Fitologys is not therapy
• Coaching does not prevent, diagnose, treat, or cure:
  • Mental health conditions
  • Psychological disorders
  • Medical diseases

Coaching is intended solely for fitness guidance, lifestyle improvement, and general well-being support.

Not a Substitute for Professional Care

You acknowledge that Fitologys services are not a substitute for:

• Counseling
• Psychotherapy
• Psychiatric treatment
• Mental health care
• Medical or legal advice

You agree that it is your exclusive responsibility to seek independent professional help from:

• Licensed medical practitioners
• Mental health professionals
• Other qualified experts

whenever required.

Existing Medical or Mental Health Conditions

If you are:

• Under the care of a mental health professional
• Experiencing psychological or emotional conditions

it is strongly recommended that you:

• Inform your healthcare provider about your participation in Fitologys services
• Seek their guidance before continuing

User Commitment

To maximize the effectiveness of the program, you agree to:

• Communicate honestly and transparently
• Be open to feedback and guidance
• Actively participate and allocate necessary time and effort

Fitologys shall not be responsible for lack of results arising from non-participation or non-compliance.

Limitation of Liability

To the maximum extent permitted by law, Fitologys shall not be liable for:

• Any mental or emotional distress
• Any decisions made by you
• Any consequences arising from your interpretation or use of coaching guidance

Acknowledgement

By using Fitologys services, you confirm that:

• You understand the scope and limitations of coaching
• You accept full responsibility for your mental and emotional well-being
• You agree to release Fitologys from any related liability

Intellectual Property Rights

Ownership of Content, Publications & Brand

All content and intellectual property available on the Platform, including but not limited to:

• Workout plans
• Diet plans
• Training frameworks and methodologies
• Research, publications, articles, and written material
• Case studies, transformation data, and reports
• Videos, audio, text, images, graphics
• Website/app design, software, and functionality

(collectively referred to as “Content”)

are the exclusive property of Fitologys Ventures LLP (“Fitologys”), unless otherwise stated.

All trademarks, brand names, logos, and identifiers including “Fitologys” are proprietary and protected under applicable intellectual property laws.

Patents & Proprietary Systems

Any:

• Processes
• Systems
• Frameworks
• Methods
• Tools or techniques

developed, used, or introduced by Fitologys, whether patented or not, shall remain the sole intellectual property of Fitologys.

Nothing in these Terms shall be construed as granting any rights to:

• Reverse engineer
• Replicate
• Commercially use

such proprietary systems.

Permitted Use (Limited License)

Subject to compliance with these Terms:

• You are granted a limited, non-exclusive, non-transferable license
• This license allows access and use of Content only for personal, non-commercial use

You may:

• View content
• Download or print limited portions for personal use

Restrictions (Strict Prohibition)

You shall not, without prior written consent from Fitologys:

• Copy, reproduce, or distribute Content
• Modify, adapt, or create derivative works
• Sell, license, or commercially exploit any Content
• Share plans, materials, or frameworks with third parties
• Use Content to create competing services

No Transfer of Ownership

• Access to the Platform does not grant ownership rights
• All rights remain exclusively with Fitologys

Downloading or accessing content does not transfer any intellectual property rights.

Third-Party Contributions

• Experts

shall also be protected, and Fitologys retains rights to use, distribute, and manage such content within its ecosystem.

Enforcement & Legal Action

In case of violation, Fitologys reserves the right to:

• Terminate access immediately
• Initiate legal proceedings
• Claim damages, including commercial loss and intellectual property misuse

Acknowledgement

By using the Platform, you acknowledge that:

• All content, publications, and systems are proprietary
• Any misuse or unauthorized use may result in legal consequence

Payments, Billing & Pricing

Accepted Payment Methods

Fitologys accepts payments through:

• All payment methods supported by Razorpay, including:
  • Credit Cards
  • Debit Cards
  • Net Banking
  • UPI
  • Mobile Wallets
  • Other digital payment modes
• Cash payments (where applicable and approved by Fitologys)

Payment Obligation

You may be required to pay a fee to access certain services.

By making a purchase, you agree to:

• Provide accurate, complete, and current payment information
• Authorize Fitologys to charge your selected payment method for the full amount

All payments must be made in advance, unless explicitly stated otherwise.

Pricing & Taxes

• All prices are subject to change at the sole discretion of Fitologys
• An additional 5% GST (or as applicable under government regulations) will be charged on all services

All payments shall be made in Indian Rupees (INR).

Invoices & Payment Receipts

• A payment receipt shall be treated as a valid invoice for all transactions
• A detailed invoice may be provided upon request by the client

Pricing Errors & Order Refusal

Fitologys reserves the right to:

• Correct any pricing errors or inaccuracies, even after payment
• Refuse or cancel any order at its discretion

In such cases, the amount (if applicable) may be adjusted or refunded as per internal policy.

Payment Security

All online payments are processed through secure and trusted payment gateways.

Fitologys uses industry-standard security practices to ensure safe transactions. However, we shall not be liable for:

• Failures due to third-party payment gateways
• Banking or technical issues beyond our control

No Refund & Chargeback Policy (Important)

• All payments made are non-refundable, unless explicitly approved by Fitologys
• Users agree not to initiate chargebacks or payment disputes without first contacting Fitologys

In case of unauthorized chargebacks:

• Fitologys reserves the right to:
  • Suspend services immediately
  • Recover the disputed amount along with applicable charges
  • Initiate legal action if required

Subscription & Renewal (If Applicable)

For any subscription-based services:

• Subscriptions may be auto-renewed, unless cancelled prior to renewal
• Users are responsible for cancelling before the renewal date

Failure of payment due to:

• Insufficient funds
• Invalid payment details

will result in suspension of services until payment is completed.

Acknowledgement

By making a payment, you acknowledge that:

• You authorize Fitologys to process payments as per these Terms

Refund, Cancellation & Dispute Policy

Strict No-Refund Policy

All services offered by Fitologys Ventures LLP are non-refundable, non-exchangeable, non-transferable, and non-saleable.

Once a service, package, or plan is:

• Purchased, and/or
• Initiated (including onboarding, session scheduling, or program access)

no refund shall be provided under any circumstances, including but not limited to:

• Change of mind
• Lack of results
• Personal, medical, or scheduling issues
• Non-usage or partial usage

Pre-Purchase Responsibility

Clients are strongly advised to:

• Review all Terms & Conditions carefully
• Understand service scope, limitations, and expectations
• Clarify all doubts with Fitologys prior to making payment

By completing a purchase, you acknowledge that:

• You have made an informed decision
• You accept all terms, including the no-refund policy

Service Commencement Definition

A service shall be considered “started” upon occurrence of any of the following:

• Onboarding completion
• Trainer/coach assignment
• Access to plans, content, or dashboard
• Scheduling or attending first session

Once any of the above occurs, the service is deemed consumed/initiated.

Exceptional Legal Circumstances

In the event that a refund is required under:

• Applicable law
• Court order
• Regulatory direction

Fitologys reserves the right to:

• Deduct applicable processing fees, service charges, and administrative costs
• Deduct value of services already delivered or made accessible
• Apply cancellation charges as deemed appropriate

Refunds, if any, shall be processed at the sole discretion of Fitologys in compliance with such legal requirements.

Cancellation Policy

• Cancellation requests, if any, must be raised through official communication channels
• Cancellation does not guarantee refund eligibility
• Approved cancellations may result in termination of access without compensation

Service Dissatisfaction Resolution

In case of dissatisfaction, Fitologys may (at its sole discretion):

• Offer a coach/trainer change within the same tier
• Provide reasonable support to improve service experience

No monetary compensation or refund shall be provided in such cases.

Account Termination

Fitologys reserves the right to terminate services without refund if:

• Terms & Conditions are violated
• Misconduct or misuse is observed
• False or misleading information is provided

Dispute & Chargeback Protection

You agree:

• Not to initiate chargebacks or payment disputes without first contacting Fitologys
• That unauthorized chargebacks will be treated as a breach of agreement

Fitologys reserves the right to:

• Recover disputed amounts
• Suspend or permanently block access
• Initiate legal action if necessary

Acknowledgement

By purchasing any service, you acknowledge that:

• You have read and understood this Refund Policy
• You accept the strict no-refund nature of services
• You agree to resolve concerns through Fitologys support channels

Acceptable Use & User Conduct

Permitted Use

You may access and use Fitologys services only for their intended purpose, i.e., personal fitness, wellness, and related guidance.

Use of the Platform for any unauthorized, illegal, or commercial purpose is strictly prohibited unless explicitly approved by Fitologys.

Prohibited Activities

As a user, you agree not to:

Platform Misuse

• Copy, scrape, or extract data/content to create databases or competing services
• Use automated tools such as bots, scripts, or scraping software
• Attempt to bypass security features or access restricted areas
• Reverse engineer, decompile, or tamper with the Platform

Unauthorized Commercial Use

• Use the Platform to promote or sell your own services
• Engage Fitologys trainers or users outside the platform for commercial gain
• Use Fitologys content or systems to build a competing business

Account & Identity Misuse

• Create accounts using false information
• Impersonate another user or entity
• Share, sell, or transfer your account

User Misconduct

• Harass, abuse, threaten, or harm other users, trainers, or staff
• Share offensive, defamatory, or misleading content
• Misuse support systems or raise false complaints

Security & Technical Violations

• Upload viruses, malware, or harmful code
• Attempt to disrupt platform operations or servers
• Use spyware, tracking tools, or unauthorized data collection methods

Legal & Ethical Violations

• Use the Platform in violation of any applicable laws or regulations
• Engage in fraud, deception, or unethical practices
• Disparage or harm the reputation of Fitologys or its ecosystem

Content Responsibility

You are solely responsible for any:

• Comments
• Feedback
• Information shared

on the Platform.

You agree that:

• Your content will not violate any laws
• You will not post defamatory or harmful material

Fitologys shall not be held liable for user-generated content, in line with applicable laws including provisions similar to intermediary protections under Indian IT regulations

Enforcement & Actions

Fitologys reserves the right to:

• Suspend or terminate your account
• Restrict access to services
• Remove any content
• Take legal action

in case of violation of these Terms.

Liability for Misuse

You acknowledge that:

• Any misuse of the Platform may result in civil and/or criminal liability
• You may be held responsible for damages caused to:
  • Fitologys
  • Other users
  • Third parties

Termination of Access

Your access to the Platform may be revoked at any time, without notice, if:

• You violate these Terms
• Your conduct is deemed harmful to the platform or its users

Acknowledgement

By using Fitologys services, you agree to:

• Follow all conduct guidelines
• Use the Platform responsibly
• Accept consequences for violations

Harassment & Community Safety Policy

Zero Tolerance Policy

Fitologys Ventures LLP (“Fitologys”) maintains a zero-tolerance policy towards harassment, abuse, or harmful behavior.

We are committed to creating a safe, respectful, and growth-oriented environment for all users, trainers, and staff.

This policy applies to:

• All users (clients, members)
• Trainers, coaches, consultants
• All interactions (online, offline, messages, groups, sessions)

Strict Prohibition of Harassment

Users shall not engage in any form of harassment, including but not limited to:

1. Unwanted Communication

• Repeatedly contacting a person despite refusal
• Spamming or unsolicited messaging

Governing Law & Dispute Resolution

Governing Law

These Terms & Conditions and your use of the Platform shall be:

• Governed by and construed in accordance with the laws of India

Jurisdiction

All disputes arising out of or relating to these Terms or the use of services shall be subject to the exclusive jurisdiction of the courts at Bhopal, Madhya Pradesh, India.

Limitation Period for Claims

Any claim, dispute, or cause of action arising out of or related to the use of Fitologys services must be initiated within:

• 30 (thirty) days from the date:

Bar of Claims

Failure to initiate legal action within the above timeframe shall result in:

• Permanent waiver of the claim
• Such claim being barred and unenforceable

Acknowledgement

• All disputes will be handled under Indian law
• Jurisdiction is restricted to Bhopal courts only
• You waive the right to initiate claims beyond the specified limitation period

Dispute Resolution & Binding Arbitration

Amicable Resolution

In the event of any dispute, controversy, or claim arising out of or in connection with:

• These Terms & Conditions
• Use of the Platform
• Any services provided by Fitologys

(“Dispute”),

the parties shall first attempt to resolve such Dispute amicably within 30 (thirty) days from the date of notification.

Binding Arbitration

If the Dispute is not resolved amicably within the above period, Fitologys Ventures LLP (“Fitologys”) reserves the right to refer the Dispute to binding arbitration, in accordance with the Arbitration and Conciliation Act, 1996.

Confidentiality

• All arbitration proceedings shall be strictly confidential
• Neither party shall disclose:
  • Existence of arbitration
  • Content or outcome

except as required by law or for enforcement purposes.

Costs & Expenses

• Arbitration costs shall be shared equally, unless otherwise decided by the arbitrator
• Each party shall bear its own legal and preparation costs

Interim Relief

Either party may approach a court of competent jurisdiction at Bhopal, Madhya Pradesh for:

• Interim or urgent relief
• Protection of rights or property

pending completion of arbitration.

Exceptions to Arbitration

The following matters shall not be subject to arbitration:

1. Disputes related to intellectual property rights enforcement or validity
2. Cases involving:
   • Theft
   • Piracy
   • Unauthorized use
   • Data/privacy violations
3. Claims seeking injunctive or immediate relief

Such matters shall be resolved exclusively by courts at Bhopal, Madhya Pradesh.

Survival Clause

This arbitration provision shall:

• Survive termination of the Agreement
• Continue to apply even after cessation of services

Severability

If any part of this clause is found to be:

• Invalid or unenforceable

the remaining provisions shall continue in full force, and such disputes shall be resolved through courts of competent jurisdiction as specified above.

By using Fitologys services, you agree that:

• Disputes will first be attempted to be resolved amicably
• Arbitration shall be the primary mode of dispute resolution
• Legal recourse is limited as per this clause

Sexual Harassment & Misconduct Policy

Fitologys Ventures LLP (“Fitologys”) maintains a strict zero-tolerance policy towards any form of sexual harassment, misconduct, or inappropriate behavior.

• Clients and users

• Not initiate or entertain any sexual or romantic conduct

Any violation shall be treated as serious professional misconduct.

Reporting & Evidence

Users are encouraged to report any incident with:

• Screenshots
• Chat logs
• Call records
• Any other supporting evidence

Fitologys will review complaints based on available evidence and internal assessment.

Enforcement & Consequences

Upon establishing credible evidence of misconduct, Fitologys reserves the right to:

• Immediately suspend or terminate access
• Debar the individual indefinitely from the Platform
• Remove association with Fitologys permanently
• Take legal action where applicable

No Refund & Immediate Action

• Any user or trainer found violating this policy will be removed without notice
• No refund or compensation shall be provided

Platform Liability Disclaimer (Very Important)

Fitologys acts solely as a facilitator of services and connections.

• Employees
• Representatives

shall not be liable under any circumstances for:

• Personal interactions between users
